Neutral Citation No. - 2025:AHC:109043-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 992 of 2025 Petitioner :- Smt. Inda Devi Respondent :- State of U.P. and 5 others Counsel for Petitioner :- Ashok Kumar Nigam, Udai Shankar Chauhan Counsel for Respondent :- C.S.C., Somya Chaturvedi, Sunil Kumar Singh Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. Petition has been filed by the petitioner purportedly in public interest to take necessary action against the brick kiln, established and operated by respondent No. 6, in violation of provisions of the Uttar Pradesh Bricks Kilns (Site Criteria for Establishment) Rule, 2012. 2. On previous occasion, when the matter came up before the Court, it was indicated that the distance between the petitioner's house and the brick kiln in question is about 25 kms. 3. Counsel for the petitioner was directed to obtain instructions in the matter. Today, learned counsel, on instructions, submits that the distance is 15 kms. 4. A perusal of the petition indicates that except for indicating that the matter in question is a public interest matter, not a word has been indicated as to how the petitioner is affected by the brick kiln in question, as the residence of the petitioner is at a distance of 15 kms. from the brick kiln in question. 5. Apparently, the petitioner is acting at the behest of someone else who is affected on account of the business being conducted by respondent no. 6. 6. Filing of a PIL, in the said circumstances, cannot be countenanced. The petition has no substance and the same is, therefore, dismissed.
