This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. (Filing) No. 22874 of 2024 to its original file. Learned counsel for the petitioner submits that A.B.A. (Filing) No. 22874 of 2024 was dismissed for non-compliance of peremptory order of this Court dated 08.01.2025. It is next submitted that due to inadvertence, the defects pointed out by the stamp reporter could not be removed within the time stipulated vide order dated 08.01.2025. It is next submitted that the petitioner has very good grounds to agitate in the said anticipatory bail application. It is then submitted that non-compliance of the peremptory order of this Court dated 08.01.2025 was neither deliberate nor intentional and unless A.B.A. (Filing) No. 22874 of 2024 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the A.B.A. (Filing) No. 22874 of 2024 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. (Filing) No. 22874 of 2024 is restored to its original file to the stage at which, it was before its dismissal.
