GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a writ of Mandamus, declaring the actions of the third respondents is illegal, arbitrary, and in violation of the fundamental rights guaranteed under the Constitution of India and instructing them not to harass me by summoning me unnecessarily to the police station. Moreover, I seek a directive for the third respondent to abstain from interfering in civil matters, especially considering that case CP. 42/2023 is pending before the National Company Law Tribunal (NCLT). The third respondent has no jurisdiction to intervene or settle the matter before him based on the complaint and 2 influence of the fourth respondent, and consequently the Honhle Court may be pleased to intervene and issue interim orders to the third respondent, directing them not to harass me by calling me to the police station unnecessarily,and to refrain from taking any coercive actions during the pendency of this writ petition.” 2. Heard Sri G.N.V.Pulla Rao, learned counsel for the petitioner and Sri Ajay Babu, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that the petitioner was called to the police station to record his statement and to submit the enquiry report. Basing on the complaint made by the respondent No.4, no crime has been registered against the petitioner and the police are not interfering in the civil disputes between the parties. 4. Considering the submissions made, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
