JUSTICE SURAJ GOVINDARAJ) 1. Sri.Chandrashekar R Hiremath accepts notice for respondent Nos.1 and 2. 2. The petitioners are before this Court seeking for the following reliefs: 1. Issue a writ in the nature of Mandamus or any other writ or order or direction to the respondents to consider the representation dated 29.01.2024 (Annexure-N and P) and refer them for fresh physical/medical test and thereafter issue appointment order to the petitioners for the post of Junior Power man in terms of final selection list at Annexure - J in accordance with law, under the facts and circumstances of the cases. 2. Grant such other further relief as may deem fit in the circumstances of the case. 3. The petitioners claim to be the aspirants for employment at respondent No.2 and are claiming that they being physically disabled would be entitled to the benefit provided for physically disabled persons. The representation submitted by them for - 3 - HC-KAR NC: 2025:KHC-D:9348 WP No. 102958 of 2025 conducting a medical examination not having been accepted, the petitioners are before this Court. 4. The representation having been submitted for a physical/medical test for a physically handicapped person, I am of the opinion that respondent Nos.1 and 2 ought to have conducted the said test through the State Advisory Board on Disability to ascertain if there is any physical disability on the part of the petitioners which comes within the purview of the Rights of Persons with Disabilities Act, 2016 and or the applicable Rules of respondent Nos.1 and 2. The same not having been done, I pass the following: ORDER i. Writ Petition is allowed. ii. Mandamus is issued directing respondents to consider the representation dated 29.01.2024 at Annexures-P and Q and get conducted a physical/medical test of the petitioners through the State Advisory Board on Disability by - 4 - HC-KAR NC: 2025:KHC-D:9348 WP No. 102958 of 2025 informing the petitioners of the date of such test to be conducted. iii. It is made clear that this Court has not expressed any opinion on the merits of the matter and or the entitlement of the petitioner.
