GP FOR ENDOWMENTS The Court made the following: 3 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "….to issue a writ of MANDAMUS or any other appropriate writ, order or direction to DECLARE the action of the 4th respondent in not conducting survey, sub-division and issue pattadar passbooks to the subject agricultural property admeasuring an extent of Ac. 14-57 cents situated in S.No.384 and 255/2 of Nanduru village, Ponnuru mandalam, Guntur district by considering the petitioner's representation dated 07.10.2022, as illegal, arbitrary, unconstitutional and violative of Articles 14 and 300-A of Constitution of India and consequently COMMAND the 4th respondent officer to conduct survey, sub-division and issue pattadar passbooks to the subject agricultural property stated supra in the interest of justice and pass such other orders……" 2. Aggrieved by the action of the 4th respondent in not conducting survey and sub-division of the subject property admeasuring Acs.14.57 cents situated in Sy.Nos.384 & 255/2 of Nanduru Village, Ponnuru Mandalam, Guntur District, the present Writ Petition is filed. 3. Learned counsel for the petitioner would submit that the present Writ Petition is filed in the year 2023 and no counter is filed by the Revenue Department. Hence, he would request this Court to direct the 4th respondent-Tahsildar to address the representation dated 07.10.2022. 4. Learned Assistant Government Pleader would request this Court that the petitioner may file fresh representation and the same will be addressed by the 4th respondent-Tahsildar in accordance with law. 4 5. Acceding to the request made by the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the petitioner to file fresh representation to the 4th respondent – Tahsildar within a period of four (4) weeks from the date of receipt of a copy of this order and, on filing such fresh representation, the 4th respondent – Tahsildar is directed to address the fresh representation in accordance with law within a period of four (4) weeks therefrom. The petitioner is also directed to attach a copy of the proceedings dated 13.03.2023 of the Deputy Commissioner, Endowments Department, Guntur, along with the representation. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
