2. On due consideration, for the reasons mentioned in the RAVI SHANKAR MANDAVI Digitally signed by RAVI SHANKAR MANDAVI Date: 2025.10.06 13:11:14 +0530
2 application, I.A. No.01/2025 is allowed and the delay of 15 days in filing the present review petition is hereby condoned.
3. The present review petition has been preferred by the applicant/review petitioner seeking following relief/s :
“I. This Hon'ble Court kindly be pleased to review the order dated 14.07.2025 passed in TPC No. 97/2025. II. This Hon'ble Court may kindly be pleased to modify the order dated 14.07.2025 passed in TPC No. 97/2025 and direct that the Civil Suit No.34A/2025 (HMA. No. Unregistered/2025), Aditya Gupta Vs Abhida Gupta, be transferred from District and Session Court, Gariyaband (CG) to Family Court, Raipur (CG). III. Cost of this petition be awarded to the Petitioners. IV. Any other relief/reliefs, order/orders, direction/directions and writ/writs as may be deemed fit by the Hon'ble Court in the facts and circumstances of the case.”
4.
Learned counsel for the applicant/review petitioner would submits that the applicant/review petitioner had filed Divorce Petition bearing Civil Suit number 34-A / 2025 (Aditya Gupta vs. Smt. Abhidha Gupta) before the Family Court, Bilaspur which has been transferred from Family Court, Bilaspur to the Court of Additional District Judge, Gariyaband, in compliance of order dated 14.07.2025 passed by this Court in TPC No.97/2025. He further submits that since petitioner is resident of Bilaspur, therefore, it
3 would be difficult for him to go to Gariyaband, as the distance between Bilaspur and Gariyaband is about 214 Kms, hence, it would be convenient for both the parties, if the case is transferred from the Court of Additional District Judge, Gariyaband to Family Court, Raipur, hence, he prays that order dated 14.07.2025 passed by this Court in TPC No.97/2025 be modified accordingly.
5. Per contra, learned counsel appearing for the respondent would submits that there is no apparent mistake in order dated 14.07.2025, therefore, it can not be reviewed.
6. I have heard learned counsel for the parties and perused the material available on record.
7. It is settled position of law that in review petition very limited scope is available to disturb the order only on the ground that if there is any apparent error/mistake in the impugned order, but there is no apparent error in the impugned order dated 14.07.2025 passed by this Court in TPC No.97/2025. Hence, I do not find any good ground to review aforesaid order.
8. Accordingly, instant Review Petition deserves to be dismissed and is hereby dismissed.
