THE HONOURABLE SRI JUSTICE D. RAMESH WRIT PETITION NO: 27449/2025 The Court made the following Order:
This Writ Petition is filed under Article 226 of Constitution of India, seeking the following relief:
“... to issue writ or order more particularly one in the nature writ of mandamus or an appropriate writ or order declaring the action of Respondents particularly Respondent Nos.2 to 4 in not considering my representation, dated 28.08.2025 submitted for deletion of my landed property admeasuring Ac.1.00 Cents covered by Sy.No.1010 of Anantarajupeta Village of Railway Kodur Mandal, Annamaya District, Erstwhile Kadapa District from the List of Prohibited Properties under Section 22 (A) of the Registration Act, 1908 Registration and release of the pending documents bearing Pending Doc.Nos.1, 2, 3, 4 of 2024, dated 09.01.2024 and Pending Doc.No.5 of 2024, dated 10.01.2024., as illegal, irregular, irrational, amounts of non-discharge of legal obligation conferred on them under the provisions of Registration Act, 1908 and Rules framed there under and offends Articles 14, 21 and 300-Aof Constitution of India and consequently direct the Respondent Nos.2 to 4 to remove said property from the list of Prohibited Properties for registration, register and release the said pending documents”. 2. It is the case of the petitioner that the petitioner purchased Ac.1.00 cent of agricultural land in Sy.No.1010 of Anantarajupeta Village under a registered sale deed dated 29.04.2022 and has been in continuous possession, with all pattadar passbooks, title deeds, and revenue records issued in his name. Certain relatives of the petitioner’s father falsely claimed the land as ancestral property and filed O.S.No.131/2023 for partition, obtaining an ad-interim

injunction on 21.08.2023 against the petitioner’s father.
Though the petitioner is the actual owner and was not a party to the suit, relying on this injunction, the 4th respondent refused to register several documents presented by the petitioner, keeping them pending as P.Doc.Nos.1–5 of 2024. Appeals against such refusal were dismissed on 08.04.2024. 3. The petitioner and his vendee approached the High Court in W.P.No.31441/2023, wherein the Court directed the registering authority to receive and process the document in accordance with law. However, registration was still refused. Later, the petitioner's relatives filed W.P.No.3787/2024, as there is a interim injunction in the civil suit and pendency of the writ petition, the petitioner’s property was wrongly included in the prohibited list under Section 22-A of the Registration Act. 4. Learned counsel for the petitioner submitted that the petitioner has also made representation dated 28.08.2025 seeking deletion of the subject property from the list of prohibited properties. Even after receipt of the said representation, the respondent authorities have neither considered the same nor issued any proceedings till date. Hence, the present Writ Petition
5. Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing on behalf of the respondents. 6. On the other hand, learned Assistant Government Pleader appearing on behalf of the respondents submitted that there is a prescribed procedure to be

followed for deletion of the properties from the list of prohibited properties under Section 22-A(1)(C) of the Registration Act, 1908. The petitioner is required to file an online application for removal of their property from the said list. Upon submission of such application, the respondent authorities will consider the same and pass appropriate orders within a reasonable time, in accordance with law. 7.
Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, and upon perusal of the material available on record, this Court is of the considered view that the present writ petition can be disposed of by granting liberty to the petitioner to file an online application before the 2nd respondent/District Collector within a period of two (02) weeks from the date of receipt of a copy of this order. Upon submission of such application, the respondents concerned shall consider the same and pass appropriate orders within a period of two (02) months thereafter, in accordance with law. 8. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. __________________________ JUSTICE D.
