PUBLIC PROSECUTOR THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 12117 OF 2025 ORDER: The present petition is filed under Sec. 528 of Bharathiya Nagarik Suraksha Sanhitha, 2023 seeking quash of proceedings against the petitioner in CC.No. 134 of 2021, pending on the file of Principal Junior Civil Court, Narasapur, registered for the offences under Sections 448, 354, 506 IPC. 2. Heard Sri.Jakkamsetty Sarachandra Babu, learned counsel for petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor, on behalf of the State. 3. Learned counsel for the petitioner would submit thatthere are disputes between the husband of Respondent No.2 and the petitioner and to yield petitioner to their terms, the Respondent No.2 foisted a false case against the petitioner. Previously, the husband of petitioner filed several cases against the petitioner. Learned counsel would further submit that there are no specific allegations against the petitioner and prays to allow the petition. 4. Learned Assistant Public Prosecutor representing on behalf of the state would submit that there are serious allegations against the petitioner and the police filed chargesheet against the petitioner after due investigation and prays for dismissal of petition. 5. Considering the submissions made and perusal of material placed on record, it is alleged that the petitioner abused Respondent No.2 in her house and threatened her for speaking about illegal activities of the petitioner in a press meet. This court cannot go into factual aspects to decide the truth or otherwise about the allegations levelled against the petitioner. The Trial Court has taken cognizance of offences, against the petitioner and the truth will come out only after full length of trial. In that view, the petition is dismissed. However, the petitioner is at liberty to raise all his contentions in his defence before Trial Court and the Trial Court may appreciate the same, in accordance with law.
