B.Consequently, direct the Respondents No. 1 to 4 to take appropriate measures including passing necessary orders under Section 144 and effective preventive steps including preventive arrests of the miscreants including the unofficial respondents under Section 149 and 151 of the Criminal Procedure Code in order to maintain law and order and public
order in and around the factory premises of the Petitioner. C.Declare the inactions of the Respondents No. 3 and 4 upon the complaints filed by the Petitioner as illegal, arbitrary and unconstitutional and consequently, direct the Respondent Nos. 3 and 4 to protect police protection to the Petitioner thereby restore the law and order, public order and ensure preventing the occurrence of any incident creating law and under situation in and around the factory premises of the Petitioner in the interest of justice. IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents to provide police protection to the Petitioner and deploy police pickets and patrolling vehicles in and around the factory premises of the Petitioner pending the disposal of the above writ petition and pass IA NO: 2 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents to act urgently on the situation prevalent and impose restrictions under Section 144 of the Code of Criminal Procedure and take appropriate preventive measures including preventive arrests of the miscreants including the unofficial respondents under Section 149 and 151 of the Code of Criminal Procedure thereby protecting the life and property of the Petitioner Company and its workmen and employees and thereby maintaining law and order, public order pending the disposal of the above writ petition and pass Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a Writ, order or direction and more particularly one in the nature of Writ of Mandamus and A.Declare the inactions of the Respondents No.1 to 4 to protect and preserve the law and order and public order in and around the premises of the Petitioners factory by taking appropriate measures including passing necessary orders under Section 144 and effective preventive steps including preventive arrests under Section 149 and 151 of the Criminal Procedure Code to protect and prevent obstruction annoyance or injury to any person lawfully employed either directly or indirectly or danger to human life health or safety or a disturbance of the public tranquillity as arbitrary, illegal unconstitutional and contrary to the Code of Criminal Procedure 1973; B. Consequently, direct the Respondents No 1 to 4 to take appropriate measures including passing necessary orders under Section 144 and effective preventive steps including preventive arrests of the miscreants including the unofficial respondents under Section 149 and 151 of the Criminal Procedure Code in order to maintain law and order and public order in and around the factory premises of the Petitioner; C. Declare the inactions of the Respondents No.3 and 4 upon the complaints filed by the Petitioner as illegal, arbitrary and unconstitutional and consequently, direct the Respondent Nos.3 and 4 to provide police protection to the Petitioner thereby restore the law and order, public order and ensure preventing the occurrence of any incident creating law and under situation in and around the factory premises of the Petitioner in the interest of justice…”

2. Heard Sri Avinash Desai, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home.

Learned counsel for the petitioner would submit that in the light of the interim order passed by this Court, no further orders are required in this matter. Learned counsel further would submit that making the interim order as absolute, the petition may be disposed of.
4. For ready reference, interim order passed by this Court on 18.03.2021 in I.A.No.1 of 2021, is extracted hereunder:-
“In the meanwhile, there shall be an interim direction to the respondents 1 to 4 to provide adequate police protection to enable the petitioner-Company to carry on its business activities without there being any obstruction from the workmen. In case of exigency as stated in the Affidavit, depending on the situation, the respondents-Police officials shall also take appropriate preventive measures to control the situation at the premises of the Company to prevent any untoward incidents to take place. The petitioner shall bear necessary expenses to provide police aid as ordered by this Court.”
5. In that view, the Writ Petition is disposed of making the interim order as absolute. No costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________
