AGED 32 YEARS, RESIDENT OF ATTILI VILLAGE AND MANDAL, WEST GODAVARI DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents 2 to 5 especially respondent No. 5 in not taking any action against the respondents 6 to 13 on to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents 2 to 5 especially respondent No. 5 in not taking any action against the respondents 6 to 12 on the report/complaint dt. 15.10.2025 given by me as, illegal, arbitrary and contrary to the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 and also violation of principles of natural justice and also violation of Article 14, 19 and Art. 21 of the Constitution of India and consequently to direct the Respondent No.5 to register the FIR basing on the report/complaint of the petitioner dt. 15.10.2025 and take appropriate action against the respondents 6 to 12 in accordance with law and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased 3 to direct the Respondent No.5 to register the FIR basing on the report/complaint of the petitioner dt. 15.10.2025 and take appropriate action against the respondents 6 to 12 in accordance with law pending disposal of the above writ petition and to pass Counsel for the Petitioner: 1. GP FOR HOME 4 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 32045 of 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the Respondent Nos. 2 to 5 especially Respondent No. 5 in not taking any action against the Respondent Nos. 6 to 13 on to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the Respondent Nos. 2 to 5 especially Respondent No. 5 in not taking any action against the Respondent Nos. 6 to 12 on the report/complaint dt. 15.10.2025 given by me as illegal, arbitrary and contrary to the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 and also violation of principles of natural justice and also violation of Article 14, 19 and Art. 21 of the Constitution of India and consequently to direct the Respondent No.5 to register the FIR basing on the report/complaint of the petitioner dt. 15.10.2025 and take appropriate action against the respondents 6 to 12 in accordance with law and to pass..…” 2. When the matter was taken up for hearing, Sri V.Farook, learned Assistant Government Pleader for Home, on written instructions, would submit that upon receiving the report from the Petitioner, the Respondent-Police conducted a preliminary enquiry and summoned both the Petitioner and the Unofficial Respondents. He would further submit that on 26.10.2025, the Unofficial Respondents appeared before the Police Station, but the Petitioner did not attend. Thereafter, on 17.11.2025, the Petitioner appeared before the Police Station and informed that the matter had been settled before the elders and that she is leading her conjugal life with her husband/Respondent No.6, 5 and accordingly requested the Police not to take any action on her complaint. Respondent No.5 also recorded her statement to that effect. 3. Sri Gowri Sankar Cheekatla, learned Counsel for the Petitioner would submit that recording the same, the petition may be disposed of. 4. Recording the submissions made by the learned Assistant Government Pleader for Home, this Writ Petition is disposed of. There shall be no order as to costs.
