The petitioner has filed this writ petition seeking for a writ in the nature of mandamus to direct the respondent Nos.1 to 3 to determine/revise his terminal benefits by extending the benefit of 6th revised pay scale and to release the same with arrears and other consequential benefits by considering his representation dated 10.01.2019. 2. The petitioner contends that he was working as Sheristedar and retired from service on 30.06.2017. He contends that after he attained the age of superannuation, the terminal benefits were determined on the basis of 5th revised

pay scale. He contends that the State Government had accepted the report of 6th pay commission and issued a Government Order bearing No.FD-06-SRP-2018, BENGALURU, dated 01.03.2018 by revising the pay scale of the employees.
The petitioner therefore, contends that the revised pay scale was to come into effect from 01.07.2017 and financial benefits had to be provided to the employees from 01.04.2018. The petitioner contends that he submitted a representation to respondent Nos.1 to 3 on 10.01.2019 requesting them to revise his retirement benefits by applying revised pay scale as per 6th pay scale. However, the said representation was not considered. Therefore, the petitioner is before this Court seeking for a direction to respondent Nos.1 to 3 to consider the representation. 3. The learned counsel for the petitioner contends that the benefit of 6th pay commission was to be extended to all those employees, who were in service as on 01.07.2017 and therefore, the petitioner is entitled for recalculation of the retirement benefits based on the revised pay scale. - 4 -

The learned High Court Government Pleader for respondent Nos.1 to 3 submitted that if the petitioner is entitled to retirement benefits on the basis of revised pay scale in view of 6th pay commission report, which was accepted by the State Government, the same shall be considered in accordance with law. 5. In that view of the matter, writ petition is disposed off directing the respondent Nos.1 to 3 to consider the case of the petitioner for revising his retirement benefits by extending the benefit of 6th pay commission and if the petitioner is entitled to the same, grant the said benefit, which shall be done within a period of three months from the date of receipt of a certified copy of this Order.
