3
ORDER: Respondent/6th defendant/proposed party in I.A.No.317/2025 in O.S.No.22/2020 filed the above revision against the order dated 15.9.2025 in I.A.No.317/2025 in O.S.No.22/2020 on the file of the learned Principal Civil Judge (Senior Division), Kovvur.
2.
Learned counsel for the revision petitioner submitted that the petitioner herein is the third party who was impleaded as 6th defendant in the suit in I.A.No.317/2025 in O.S.No.22/2020 on the file of the learned Principal Civil Judge (Senior Division) Kovvur wherein the plaintiff therein filed an application under Order I Rule 10 and Order VI Rule 17 of CPC praying the Court to permit the petitioner/plaintiff therein to bring on record the proposed party i.e. the petitioner herein as defendant no.6. The said application was allowed. Learned counsel for the revision petitioner mainly contended that the said orders are contrary to the orders passed by this Court in between Kuna Ramulu vs. Kuna Annapurnamma and others 1 wherein this Court has considered the identical issue and held that the property having been purchased during the pendency of the litigation is hit under Section 52 of the Transfer of Property Act. Therefore, the purchaser is neither a necessary party nor a proper party and he cannot be permitted to come on record.
