Respondent(s) For Petitioner(s) : Mr.Vivek Kumar Shrivastava, Advocate For Respondent- State For Respondents No.2 and 4 : : Mr.Shashank Thakur, Deputy Advocate General Mr.Animesh Tiwari, Advocate BABLU RAJENDRA BHANARKAR Digitally signed by BABLU RAJENDRA BHANARKAR 2 Hon'ble Shri Ramesh Sinha, Chief Justice Hon'ble Shri Bibhu Datta Guru , Judge Order on Board Per Ramesh Sinha , Chief Justice 14.10.2025 1. Heard Mr.Vivek Kumar Shrivastava, learned counsel for the petitioner as well as Mr.Shashank Thakur, learned Deputy Advocate General appearing for the respondent-State and Mr.Animesh Tiwari, learned counsel appearing for respondents No.2 & 4. 2. By way of this petition, the petitioner has prayed for following reliefs:- “(i) That this Hon’ble Court may kindly be pleased to set aside the impugned NIT dated 15.9.2025 and the proceedings conducted in pursuance thereof and direct the respondent authorities to issue a fresh NIT by rectifying the tender conditions pointed out by the petitioner. (ii) That this Hon’ble Court may also kindly be pleased to grant any other relief deemed fit in the facts and circumstances of the case to the petitioner including cost of the petition.” 3. Facts of the case are that the petitioner is a civil contractor and engaged in the business of transportation. The respondent authorities issued NIT on 15.9.2025 for handling, transport and 3 other mining services-percentage quote based-handling service, transport service. The bid end date is 6.10.2025 at 11:00 and bid opening date is 6.10.2025 at 11:30. However, there are certain conditions in the said NIT which are wholly unreasonable and impractical, such as Point No.7 of the tender instructions which states आयकर स्थायी लेखा संख्या प्रपत्र एवं विवगत तीन विवत्तीय वर्ष 2022-23, 2023-24 एवं 2024-25 की आयकर विववरण की सत्यप्रतितलिलविप, under Point No.6 Miscellaneous, it is stipulated that विनविवदाकार द्वारा विनविवदा में जो दर प्रस्तुत की जावेगी, उक्त दर के संबंध में विनविवदाकार को औति,त्य सवि-त कारण (price justification) जिजला स्तरीय कमेटी के समक्ष प्रस्तुत करना अविनवाय -ोगा, जिजसका जिजला स्तरीय कमेटी द्वारा परिरक्षण कर मान्य/ अमान्य विकया जावेगा। and Point No.8 requires bank statement of the bidder from 1 April, 2023 to 31 March, 2025 whereas Point No.17 of the Technical Bid requires bank statement from 1 April, 2022 to 31 March, 2024. Though the petitioner on 3.10.2025 submitted a representation before respondent No.4 / District Marketing Officer, Janjgir for rectifying the unreasonable condition mentioned in Point 1.2(7), no decision is taken thereon till date. Hence this petition. 4. Learned counsel for the petitioner submits that the NIT issued by the respondent authorities on 15.09.2025 for handling, transport, and other mining services—percentage quote based on handling and transport services contains conditions, as pointed out by learned counsel for the petitioner, namely, 7. and 17. बैंक स्टेटमेंट 01 अप्रैल 2022 से 31 मा, 2023 एवं 01 अप्रैल 2023 से 31 मा, 2024 तक का। ( प्रतित संलग्न करें), as appearing at pages 15 and 21 of the writ petition, which appear to be ambiguous. Consequently, the petitioner was unable to submit his bid in response to the NIT, though he has made a representation on 03.10.2025 seeking necessary clarification. 5. Learned counsel appearing for respondents No. 2 and 4 submits that the representation furnished by the petitioner pertains solely to the Income Tax Return. However, the issues raised before this Court, as mentioned in pages 15 and 21 of the writ petition, do not form part of the said representation. He fairly admits that there exists some ambiguity in this regard, and accordingly, the case of the petitioner shall be considered on its merits. 6. In view of the foregoing, the petitioner is at liberty to approach respondent No. 4 for redressal of his grievance, which shall be considered by respondent No.4 as has been assured by Mr.Animesh Tiwari, learned counsel for respondents No.2 and 4. 7. With the aforesaid observation / direction, the writ petition stands disposed off. No cost(s). Sd/- Sd/- Sd Sd/- Sd/- (Bibhu Datta Guru) (Ramesh Sinha) Judge Chief Justice Bablu
