ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue a Writ, order or direction more particularly one in nature of Writ of Mandamus, declaring the action on the part of Officials of Respondent No.3 in calling Petitioners to Police Station there by directing them to leave their respective residential villages Kadarampalli, M.Venkatampalli, Kalyanadurgam Mandal, Anantapur District till adjudication of PRC.No.27 of 2023 on the file of Judicial First Class Magistrate Kalyanadurgam as illegal, arbitrary, against the principles of natural justice and consequently direct the Officials

of Respondent No.3 to not to interfere with legal activities of Petitioners herein.”
2. Heard Sri N.Chandra Sekhar Reddy, learned counsel for the petitioners and Sri Ajay Babu, learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home would submit that, initially, the petitioners were called for counselling to correct their high-handed behaviour and were instructed to stay for a few days in another village, as the complainant party was still in deep shock over the death of the deceased. It was further submitted that, if the petitioners returned to their native village, there is every possibility of an attack on petitioners by the complainant party, which might lead to a law and order problem in the village. On the other hand, there is also an apprehension that the petitioners might force or threaten the witnesses not to support the complainant by deposing before the Court.

Learned counsel for the petitioners would submit that the petition may be disposed of by giving directions to the concerned Court to commit the PRC.No.27 of 2023 on the file of Judicial First Class Magistrate, Kalyanadurgam, at the earliest point of time. Learned counsel would further submit that liberty may be given to the petitioners to file an appropriate application at the appropriate time.
5. Considering the submissions made, the Writ Petition is disposed of. However, the learned Magistrate is directed to proceed with the matter in P.R.C. No.27 of 2023 and take necessary steps to commit the same to the Sessions Division as expeditiously as possible. The petitioners are at liberty to

file a fresh application as and when necessary. There shall be no order as to costs.
