ORAL ORDER:
Heard Sri S. Varadarajulu Chetty, learned Counsel for the Petitioner and Sri V. Maheswar Reddy, learned Counsel for the Respondent No.2. 2. The relevant portion of the Order passed by this Court on 24.11.2022 in W.P.No.11977 of 2022 is usefully extracted hereunder:
“The 2nd respondent has also filed the counter affidavit. In the counter affidavit filed by the 2nd respondent it is stated that as per the work order dated 07.03.2019, the Commissioner, Information and Public Relations, Vijayawada have paid Rs.1,57,51,164/- out of the total bill amount of Rs.2,16,29,096/- till date and the remaining due amount bill be paid in due course of time. Considering the submissions of the learned counsel for the petitioner and on perusal of the contents of the counter affidavits filed by Respondent Nos.2 and 3, all the respondents are directed to pay the amounts in connection with the work orders within a period of six(6) weeks from the date of receipt of copy of this order. 3. Sri V. Maheswar Reddy, learned Counsel for the Respondent No.2 has filed Counter Affidavit way back on 28.07.2023, indicating that all the payments due to the Petitioner have been paid in three spells. The extract of the Order passed by this Court would indicate that the Petitioner has already received an amount of Rs.1,57,51,164/- out of the total bill amount of Rs.2,16,29,096/-.
This would indicate that the Petitioner is entitled to receive the balance amount of Rs.58,77,932/-. The Counter Affidavit of Respondent No.2 would indicate the following payments made:
1. 28.12.2022 – 30,00,000/-
2. 14.02.2023 – Rs.8,32,000/-
3. 21.07.2023 – Rs.20,45,931/-

Having noticed the same, on the last occasion i.e., on 18.09.2025, this Court had directed the Counsel for the Petitioner to take instruction from his client since the Petitioner’s Counsel had been unresponsive despite the fact that the Counter Affidavit was filed way back on 28.07.2023. 5. Today, on instructions, learned Counsel for the Petitioner is claiming more amount almost amounting to about three (3) crores of rupees. The Order of this Court has only dealt with the balance payment of Rs.58,77,932/- whereas the learned Counsel for the Petitioner has started making a claim in a baseless manner beyond the Order passed by this Court. This is not only unreasonable but would tend to waste the time of this Court when such unreasonable and frivolous claims are projected by the learned Counsel for the Petitioner. 6. This Court is of the view that the Order passed by this Court dated 24.11.2022 in W.P.No.11977 of 2022 has been complied with and therefore, no charge of Contempt can lie against the Respondents.
