HON’BLE SRI JUSTICE K. SREENIVASA REDDY Criminal Petition No.3759 of 2025 Order: This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking anticipatory bail, in connection with Crime No.455 of 2024 of Proddatur I Town Police Station, YSR Kadapa District. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 118(1), 109 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, is that, on 15.12.2024 at about 4.30 p.m., while the de facto complainant namely Charan Kumar Reddy and one Surya Prakash Reddy were present near Gym building, Arts College complex, Proddatur Town, keeping the previous grudges in mind, the petitioner herein along with others went there and attacked them with beer bottles, stones and cricket bat with an intention to kill them and caused injuries to them. 4. Heard. Perused the record. 5. A perusal of the material on record, prima facie, goes to show that the petitioner herein and other accused attacked the de facto complainant and another with beer bottles, stones and cricket bat with an intention to kill them and caused injuries on them. Learned Additional Public Prosecutor submits that the case is still under 2 investigation and some more witnesses are to be examined. This is the second bail application filed by the petitioner herein and the earlier bail application filed by him was dismissed by this Court on 22.01.2025. There are no changed circumstances for granting anticipatory bail to the petitioner herein. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner herein. 6. Accordingly, the Criminal Petition is dismissed. 7. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _____________________ K.
