P NARAHARI BABU 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 17695 of 2021 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No.2 and 3 in threatening the petitioners and trying to interfering with petitioners possession of lands in Sy.No.1403-6 (old) new Sy.No.1403-6D and Sy.No.1403-6A, admeasuring Ac.4-80 Cents of Reddipalli Village, Nallamada Mandal, Ananthapuramu District, by orally directing them not to enter into the lands in order to help Respondent No.4 to 9, even when the matters are pending for adjudication before this Hon'ble High Court in S.A.No.942 of 2006 and another First Appeal pending on the file of the Senior Civil Judge, Kadiri and interfering with possession contrary to the orders passed in S.A.M.P.No.2228 of 2006 in S.A.No.942 of 2006 dated 16.10.2006, without any right, notice and jurisdiction as arbitrary, illegal, discriminative, in violation of principles of natural justice, misuse of powers, violative of the Fundamental Right guaranteed under Articles 14 and 300-A, the Constitutional Right guaranteed under Constitution of India, consequently direct Respondent No.2 and 3 not to interfering with petitioners possession of lands in Sy.No.1403-6 (old) new Sy.No.1403-6D and Sy.No.1403-6A admeasuring Ac.4-80 Cents of Reddipalli Village, Nallamada Mandal, Ananthapuramu District and pass….” 2. Heard Sri Srinivas Basava, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 4 3. Learned Assistant Government Pleader for Home, on instructions, would submit that the respondent-police are not interfering in the civil disputes between the petitioners and the unofficial respondents. 4. Learned counsel for the petitioners would submit that recording the same, the petition may be disposed of. 5. Recording the above said submission, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the petitioners and the unofficial respondents, except by following the due process of law. There shall be no order as to costs.
