Singh, learned Senior Advocate assisted by Shri Sankalp Narain, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The present writ petition is filed for the following relief:- "i. to issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 05.10.2019 passed by the Finance & Accounts Officer in the office of District Inspector of Schools Prayagraj (Annexure-8 to the writ petition). ii. to issue a writ, order or direction in the nature of mandamus commanding the respondent-District Inspector of Schools Prayagraj as well as the Finance & Accounts Officer, attached in the office of District Inspector of Schools, Prayagraj to grant annual increment admissible to the petitioner for the years 2017 and 2018 and accordingly fix his pay and release the arrears on that account so that justice be done." 3. Considering the submissions, this Court has passed an order on 19.03.2024, which reads as follows:- "1. Learned Standing Counsel prays for and is allowed six weeks' and no more time to file counter affidavit. 2. List on 30.04.2024." 4. Despite lapse of six years, the respondents have not chosen to file counter affidavit. 5. In the said circumstances, left with no option the impugned order dated Versus Counsel for Petitioner(s) : Hritudhwaj Pratap Sahi, Samarath Singh, Sankalp Narain Counsel for Respondent(s) : C.S.C. Shree Ram Mishra .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) 05.10.2019 is set aside, remanding the matter to the authorities to consider once again as per Regulation- 52 Chapter- III of Regulations framed under the U.P. Intermediate Education Act, 1921 and pass appropriate orders within a period of one month from the date of receipt of a copy of this order, if required by issuing notices to the petitioner. 6.
