ORAL ORDER The petitioner/husband is seeking to quash the proceedings pending in C.C.No.5078/2023 for the offences punishable under Sections 498-A, 323, 504 and 506 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
2. Today, the petitioner/husband and the second respondent/wife are present before this Court.
3. On being queried, the second respondent acknowledges that the marriage between the

petitioner and herself has been dissolved in MC No.7004/2023, and appropriate provisions have been made in respect of the minor child. The second respondent has further expressed her willingness to co-operate with the quashing of the present proceedings in view of the amicable settlement reached between the parties.
4. In light of the memorandum of settlement recorded under Section 89 of the Code of Civil Procedure, read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, and notwithstanding that the offences punishable under Section 498A of the IPC are non-compoundable, this Court finds it appropriate to quash the proceedings. The decision is informed by the fact that the matrimonial discord between the parties has been amicably resolved through the matrimonial proceedings, and the wife has consented to the

quashing of the criminal proceedings, thereby preventing any potential abuse of the process of law.
5. Accordingly, this Court passes the following
order:
ORDER (i) The petition is allowed. (ii) The proceedings pending in C.C.No.5078/2023 on the file of XXXII Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 498A, 323, 504, 506 of the IPC, and Sections 3 and 4 of the Dowry Prohibition Act, 1961, are hereby quashed.
