GP FOR LAND ACQUISITION 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.1206 of 2023 ORDER:- The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an order or direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities- i) in not paying compensation/exgratia to the lands of the petitioners totaling to an extent of Ac.21.79 cents along with 7,189 pomegranate trees existed therein; ii) in not considering the representations along with revenue record submitted by the petitioners for payment of compensation as highly arbitrary, illegal, null and void and against principles of natural justice apart from Article 300A of Constitution of India and consequently to direct the respondent authorities to pay compensation to the petitioners on par with the patta land holders in respect of the above said lands and to pass such other orders…” 2. Precisely, the present writ petition has been filed seeking a direction to the respondents to pay compensation to the petitioners on par with the patta landholders in respect of the subject property. 3. Learned counsel for the petitioners submits that it would suffice if the respondents are directed to dispose of the petitioners’ representation dated 22.09.2019. 4. As no counter-affidavit has been filed by the respondent authorities, this Court acceded to the request of the learned counsel for the petitioners. 5. At this juncture, learned State counsel requested this Court to direct the petitioners to submit a fresh representation in respect of the same cause of action. 4 6. In view of the above submissions, the present Writ Petition is disposed of, permitting the petitioners to submit a fresh representation to respondent No.2 within a period of one week from the date of receipt of a copy of this order. On receipt of such representation, respondent No.2 is directed to examine the same and pass appropriate orders in accordance with law, and communicate the said decision to the petitioners within a period of four (04) weeks thereafter. There shall be no order as to costs.
