JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner, arraigned as accused No.5 in Cr.No.118/2025 of Azad Nagar Police Station, Davanagere, registered for the offence punishable under Section 20(b)(ii)B of the NDPS Act, has preferred this petition under Section 483 of BNSS, 2023 to enlarge him on bail. 2. Heard both sides and perused the material on record. 3. As per the complaint lodged by the PSI, Azad Nagar Police Station, Davanagere, accused by name Syed Sadath Abrar, Syed Imran and M.Prashanth (petitioner) were arrested in relation to the cases registered in their police station in Crime Nos.114/2025, 115/2025 and 117/2025 under Section 27(b) of the NDPS Act and during interrogation, they alleged to have confessed that they - 3 - HC-KAR NC: 2025:KHC:38081 CRL.P No. 12701 of 2025 purchased Ganja from the accused by name Mehaboob Bee and Mohammed Hanif. They allegedly led the police behind the stadium, SSM Nagara 8B9 Block, Davanagere, from where the said two persons arraigned as accused Nos.1 and 2 were apprehended. From accused No.1, a plastic bag containing 1250 gms. of ganja was recovered under a mahazar. 4. In the case on hand, ganja was not recovered from the petitioner. Hence, petitioner, who is already arrested and interrogated, can be enlarged on bail by imposing conditions. Hence, the following: ORDER I. Petition is allowed. II. Petitioner/accused No.5 in Crime No.118/2025 of Azad Nagar Police Station, Davanagere, shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty - 4 - HC-KAR NC: 2025:KHC:38081 CRL.P No. 12701 of 2025 thousand only), with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. 4. He shall not indulge himself in committing any offence. 5. He shall appear before the trial Court regularly on all dates of hearing.
