Neutral Citation No. - 2025:AHC:72408 Court No. - 6 Case :- WRIT - A No. - 6001 of 2025 Petitioner :- Devdatt Singh And 3 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ramesh Chandra Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri R.C. Dwivedi, learned counsel for petitioners and Sri Brijesh Narain Srivastava, learned Standing Counsel for State-Respondents.
2. Petitioners are fence sitters. They have not participated or approached this Court when allegedly similar Teachers have approached this Court way back in the year 2016 and finally on basis of an order dated 24.08.2021 passed by a Division Bench of this Court in Special Appeal Defective No. 595 of 2021 their salary was released.
3. It is also not the case of petitioners that immediately thereafter they approached the concerned respondent and it appears that now after about four years of said
judgment, they have approached this Court that they may be granted similar relief.
4. Learned Standing Counsel appearing for State-Respondents submits that this belated stage no relief can be granted to petitioners.
5. I have considered the above submissions. As referred above, petitioners are fence sitters and they have not approached this Court even when other writ petitions filed by alleged similar Teachers were pending. Even after Division Bench’s judgment dated 24.08.2021 they have not taken any steps and now approached this Court after about four years. Court cannot come to the rescue of a fence sitter (See, State of U.P. and others vs. Arvind Kumar Srivastava and others:(2015) 1 SCC 347). Therefore, the relief sought cannot be granted.
6. Writ petition is accordingly dismissed.
