...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in proposing to lay the road in the private lands of the petitioners i.e., 1) land of an extent of Ac.0.15 cents in Sy.No. 16, situated at Inimerla village, Pamuru Mandal, Prakasam District, 2) land of an extent of Ac.0.23 cents in Sy.No.16, situated at Inimerla village, Pamuru Mandal, Prakasam District and erecting the electricity polls in the said lands as illegal, arbitrary and violation of principles of natural justice and also violation of Article 300-A of Constriction of India and consequently direct the respondents not to lay the road in the lands belonging to the petitioners and direct the respondents to remove the electric polls erected in the lands belonging to the petitioners and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to lay the road in the lands belonging to the petitioners i.e., 1) land of an extent of Ac.0.15 cents in Sy.No.16, situated at Inimerla village, Pamuru Mandal, Prakasam District, 2) land of an extent of Ac.0.23 cents in Sy.No.16, situated at Inimerla village, Pamuru Mandal, Prakasam District by directing the respondents to remove the electric polls erected in the lands belonging to the petitioners pending disposal of the above Writ petition and pass Counsel for the Petitioner(S):

The Court made the following order: The grievance of the petitioners is that the respondent authorities are proposing to lay road in their agricultural lands i.e., 1) land to an extent of Ac.0.15 cents in survey No.16, and 2) land to an extent of Ac.0.23 cents in survey No.16 situated at Inimerla village, Pamuru Mandal, Prakasam District and erecting the electricity polls in the said land.
2. Heard Sri C.Subodh,
learned counsel for the petitioners, Smt D.Chandrika, learned Assistant Government Pleader for Panchayat Raj, Sri Chandra Sekhar, learned Assistant Government Pleader for Revenue and Sri M.Sudhir, learned standing counsel for Gram Panchayat .

Learned counsel for the petitioners, in elaboration to what has been stated in the affidavit, contended that the subject property was assigned in favour of the petitioners. The respondent authorities, without issuing notice, without initiating land acquisition proceedings and without paying compensation, are attempting to lay a road and erect electric poles in the petitioners’ assigned patta lands. Aggrieved by the same, the petitioners filed the present Writ Petition and this Court, vide order dated 13.10.2023, directing the respondent authorities not to lay any road in the subject property pending further orders. Hence, prayed to pass appropriate orders treating the interim
order as final order.
4. On the other hand, learned Assistant Government Pleader for Panchayat Raj Department placed on record the written instructions of the Deputy Executive Engineer, PRI Sub-Division, Kanigiri dated 04.12.2025 and

submitted that the Panchayat Raj Engineering Department has not proposed to construct a road on the petitioners’ land.

Learned standing counsel for Gram Panchayat placed on record the written instructions of the Panchayat Secretary, Inimrla Gram Panchayat dated 23.11.2025 and submitted that the disputed land in survey No.16 is of a total extent of Ac.2.77 cents, out of which petitioner No.1 owns only Ac.0.15 cents and petitioner No.2 owns only Ac.0.23 cents. Both the petitioners possess agricultural lands and no road has been laid in their respective extents.
6. Perused the record and considered the submissions made by learned counsel for the parties.

The contention of the petitioners is that without issuing notice, without initiating land acquisition proceedings, the respondent authorities are attempting to lay a road and erect electric poles in the petitioners’ subject lands. On the other hand, learned Assistant Government Pleader for Panchayat Raj Department as well as learned standing counsel for Gram Panchayat contended that there is no proposal for laying road in the respective lands of the petitioners.
8. Taking the submissions of both the learned counsel into consideration and in view of the fact that there is no proposal for laying road in the petitioners’ subject property, nothing remains for further adjudication and the Writ Petition is liable to be closed.

9. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
As a sequel thereto, interlocutory applications pending, if any in the Writ Petition, shall also stand closed.
