(2) Petitioner moved an application for recall of an order dated 30.6.2014, which was dismissed for non-proseuction on 1.2.2016. Petitioner thereafter moved an application for recall of the order dated 1.2.2016, which too was dismissed by Collector, Haridwar vide order dated 11.9.2017. Petitioner thereafter filed an appeal challenging the aforesaid orders before Commissioner, Garhwal Division, which was dismissed vide judgment dated 23.1.2023. Petitioner thereafter filed revision before Board of Revenue, which was dismissed vide judgment dated 19.2.2025. Petitioner has challenged aforesaid judgments and orders in this writ petition. (3) Petitioner has produced in Court the judgment rendered by coordinate Bench on 7.4.2025 in Writ Petition (M/S) No. 881 of 2025. Learned Counsel for the petitioner submits that the said judgment was passed in a petition filed by mother of the petitioner and all other facts are identical, except the case number. Learned State Counsel concedes that in the said judgment, facts were identical. (4) Learned Counsel for the petitioner submits that in Writ Petition (M/S) No. 881 of 2025, which was decided by coordinate Bench, the number of case was 145 of 2009-10, while here the case number is 144 of 2009-10. (5) Having regard to the concession recorded by learned State Counsel, present writ petition is also decided in terms of the judgment dated 7.4.2025, rendered in Writ Petition (M/S) No. 881 of 2025. Impugned judgments and orders dated 11.9.2017, 23.1.2023 and 19.2.2025 are set aside for the reasons indicated in the aforesaid judgment. The matter is remanded back to Collector/District Magistrate, Haridwar to decide the Restoration Application No. 70 of 2015-16 afresh, in accordance with law.
