Police in initiating any action on Petitioners Representation/Complaint dated 04.10.2025, 10.10.2025 as illegal and arbitrary and violating of Articles 14 and 21 of the Constitution of India and it is further consequentially prayed that this Hon’ble Court may be pleased to direct the Respondent No. 2 to 5 to forthwith take over the case pursuant to the Representations/Complaints of the petitioner dated 04.10.2025, 10.10.2025 and investigate into, register the crime/FiR at the earliest and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent No. 2 to 5 to forthwith take over the case pursuant to the Representations/Complaints of the petitioner dated 04.10.2025, 10.10.2025 by duly registering a Crime/F.I.R. and initiating action against the persons in the complaint pending disposal of the writ petition and to pass Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a direction or order more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the Respondents Nos. 2 to 5 Police in initiating any action on Petitioners Representation/Complaint dated 04.10.2025, 10.10.2025 as illegal and arbitrary and violating of Articles 14 and 21 of the Constitution of India and it is further consequentially prayed that this Hon’ble Court may be pleased to direct the Respondent Nos. 2 to 5 to forthwith take over the case pursuant to the Representations/Complaints of the petitioner dated 04.10.2025, 10.10.2025 and investigate into, register the crime/FIR at the earliest and to pass…”
2. Heard Sri Mohammad Nayab Rasool, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the official respondents.

Learned Assistant Government Pleader for Home for the official respondents, on written instructions, would submit that basing on the complaint of the petitioner, the respondent-police have conducted a preliminary enquiry by calling the concerned parties to the police station. After due enquiry, it is found that there are civil disputes between the petitioner and 3rd parties. In respect of the same, civil suits are pending on the file Junior Civil Judge Court, Darsi vide O.S.No.289 of 2022 and O.S.No.268 of 2025. He would further submit that no crime has been registered on the complaint of the petitioner, since the subject matter is purely civil in nature.

Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.
5. Recording the same, this Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before the appropriate forum according to law. There shall be no order as to costs.
