Chaturvedy, Advocate For the State : Mrs. Vandana Bharti, A.P. P. -------- 03/ Dated 30.04.2025 Heard the parties. The petitioner has been made accused in connection with Hunterganj P.S. Case No. 115 of 2023, corresponding to N.D.P.S. Case No.104 of 2023, for the offence registered under Sections 18(b), 27(a), 28 & 29 of the Narcotic Drugs and Psychotropic Substances Act, pending in the court of Shri Shambhu Lal Shaw, learned Sessions Judge, Chatra. Bail application of the petitioner was earlier rejected by this Court in B.A. No. 780/2024, vide order dated 12.03.2024. It is alleged that on 16.06.2023 at about 11:25 a.m, Hunterganj Police apprehended the petitioner alongwith co-accused Damiya Kumari and seized 2.556 kgs of opium from their possession. The quantum of seized contraband comes within the purview of commercial quantity. Report regarding the stage of the trial and the time required for its conclusion, earlier called for, has been received. It appears that out of eight witnesses, seven witnesses have been examined and the learned Trial Court has stated that the trial will be concluded within one month. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected at this stage. Petitioner, if so advised, may renew his prayer for bail after two months, if the trial is not concluded. (Ambuj Nath, J.) BS/-
