1. Upon coming of the instant matter for further consideration, the appearing counsel for the parties being the appellant and the respondents 1 to 4 herein produced respective computation sheets of the amount of compensation awarded by the tribunal under different components/heads to the claimants/respondents based upon the law laid down by the Apex Court in various cases pertaining to motor accident claims. While the amount of compensation computed by the counsel for the appellant is Rs. 12,72,320/- as against 19,08,000/- granted by the tribunal, the computation made by the learned counsel for the respondents has been worked out at Rs. 12,78,920/- as against the amount of compensation of Rs. 19,08,000/- awarded by the tribunal. The said computation sheets are taken on record.
2. Having regard to the aforesaid position obtaining in the matter, the controversy in the instant appeal has narrowed down and accordingly with the consent of the appearing counsel for the parties the amount of compensation of Rs. 12,78,920/- i.e. the computations made by the
learned counsel for the respondents is agreed to be payable by the appellant herein to the respondents No. 1 to 4 herein. As regards the grant of interest upon the said amount of compensation is concerned the tribunal has awarded 6% interest for 3 months and 12% interest upon the awarded amount in the event the compensation is paid after 3 months. The said interest rate is not disturbed and is upheld, however, upon the now agreed amount of compensation.
3. The statutory deposit submitted by the appellant before this Court be released in favour of the appellant along with the interest, if any and the balance amount payable to either of the parties be worked out and released accordingly by the tribunal
4. Disposed of.
