GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition under Article 226 of the Constitution of India is filed by the Petitioner seeking the following relief: “....to issue a writ, order or direction more particularly one in the nature of writ of mandamus to declare that the action of the respondents 3 and 4 in interfering with civil disputes relating to an extent of Ac 3.70 cents in Survey No.129/2B of Gali bheemavaram village, Sabbavaram Mandal, Visakhapatnam District as arbitrary, illegal and without jurisdiction and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner's land and pass ...” The grievance of the Petitioner is that respondent Police are interfering in the civil matters of the petitioner and threatening him to hand over the subject land to third party. Learned Assistant Government Pleader for Home appearing for respondent State on written instructions would submit that two crimes are pending against the Petitioner and in that connection, respondent Police are calling the Petitioner to Police station and respondent Police never interfered in the civil matter of the Petitioner. Learned counsel for the Petitioner would submit that by recording the said submission this writ petition may be disposed of by passing appropriate orders. In that view, it is apposite to direct respondent Police to follow due process of law regarding the subject crimes pending against the Petitioner. Accordingly, this Writ Petition is disposed of.
