This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Criminal Case No. 1019 of 2022 in case crime no. 0217 of 2021 under Sections 323, 504, 325 I.P.C., Police Station- Madiyahu, District- Jaunpur pending in the Court of learned Additional Chief Judicial Magistrate, Jaunpur expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the said criminal case is pending since 2022 and no evidence has been recorded as yet. It is also submitted that the applicant is the informant of the said case and he is sufferer and the Court concerned is not taking proper interest in disposal of the said case. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. It appears from perusal of the order sheets that the case is pending at the stage of evidence. The applicant before this Court is the informant and she should be the first witness to be examined before the Court. It is very surprising that inspite of appearing before the trial Court for recording her evidence the applicant straightway approached this Court. These type of cases are only meant to be filed to increase the pendency of the High Court, this is not the proper way. 7. No relief is granted in this matter and no direction is to be issued to the trial Court rather the applicant is directed to appear before the Court concerned as P.W.1 and if she appears, the trial Court shall record her evidence without any delay. 8.
