The petitioner who is working as Sub Divisional Officer, Public Workds Department, Sub Division No. 1, Kondagaon has preferred the instant writ petition assailing the transfer order dated 19.09.2025 passed by Deputy Secretary, Public Works Department, Raipur whereby the petitioner has been transferred from Public Works Department, Sub BHUMIKA ANGARE Digitally signed by BHUMIKA ANGARE Date: 2025.10.16 11:22:16 +0530
2 Division No. 1, Kondagaon to Public Works Department, Sub Division Dornapal, District Sukma (C.G.) on the count of administrative exigency. 2. Learned Senior Advocate would submit that the petitioner’s wife is suffering from mental illness and nervous issue problem for which she has to visit Rajnandgaon for treatment. She would further submit that the petitioner is aged about 61 years and he is at the verge of retirement, therefore, transfer order may be quashed. 3. Per contra learned counsel for the State opposing the submission would submit that transfer is exigency of service and no government servant can claim to remain posted at particular place of posting forever and would pray for dismissing the instant petition. 4. I have heard learned counsel for the parties and perused the records. 5.
Considering this aspect of the matter that the petitioner is at verge of retirement and only one year is left for superannuation, the instant writ petition is disposed of granting liberty to the petitioner to make a representation within 3 weeks from the date of receipt of copy of order before the respondents who will consider and decide the same within 6 weeks from the date of representation. The effect and operation of transfer order so far as it relates to petitioner shall be stayed till representation is decided.
