1. The present writ petition has been filed seeking following relief:- (I) That this Hon’ble Court may kindly be pleased to call the records for kind perusal of the Hon’ble Court. By way of the present writ petition, the petitioner is challenging the order dated 04.06.2025 passed by the respondent No. 2 (Annexure P-1), arising out of the order dated 13.08.2024 (Annexure P-2) passed by the respondent No. 3, whereby the respondent No. 3 has allotted the operation of Mid-day Meals to the respondent No. 4 at Government Middle School Matiya, Block Masturi, District Bilaspur (C.G.) which is illegal and arbitrary.

Learned counsel for the petitioner submits that the petitioner is registered society having its registration number 1222292496197 and the petitioner was continuing operating the mid-time food in the School namely Government Middle School Matiya, Block Masturi, District Bilaspur (C.G.). Vide order dated 13-08-2024, the respondent No.3 has issued and directed the respondent No.4 for operating of the middle-time food of the said school. Being aggrieved by the order dated 13-08-2024, the petitioner filed appeal before the respondent No.2. The respondent No.2 after taking into consideration of the documents and material on record, has rejected the appeal filed by the petitioner and upheld the order 13-08-2024 (Annexure P- 2) vide its impugned order dated 04-06-2025 (Annexure P-1), which is illegal and arbitrary.

Learned counsel for the petitioner further submits that the respondent No.4 society has been registered twice i.e. in the year 2016 and also in the year 2024 and the members are the same in both the societies and forgery and fraud has been committed by the respondent No.4 and the respondent No.4
3 have concealed the registration of the said society twice at the time of submitting the form for operation of Mid-day Meals. The fact is evident from the copy of registration certificates. Hence, this petition.

Learned counsel for the respondent-State submits that it is not a case herein that the allotment of the petitioner has been cancelled and the same has been given to third party. However, he referred to the order-sheet dated 04.06.2025 of the impugned
order whereby it shows that the petitioner was not the registered society at the time of allotment of operation of Mid-day Meals to the respondent No. 4. Hence the present writ petition is not maintainable.
6. I have heard learned counsel for the parties and perused the records with utmost circumspection.

On perusal of records, it transpires the fact that the petitioner is aggrieved by the order dated 13.08.2024 whereby the operation of the Mid-day Meals has been allotted to the respondent No. 4 at Government Middle School Matiya, Block Masturi, District Bilaspur vide Annexure P/2 and the allotment order was passed on 13.08.2024, thereafter the petitioner-society was registered on 23.08.2024. As such the petitioner was not a registered society at the time of allotment of the operation of the Mid-day Meals to the respondent No. 4. Therefore there is no good ground to entertain this petition. Accordingly, the present writ petition stands dismissed.
