GP FOR HOME 2 The Court made the following: ORDER: The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief: “.... to issue a Writ, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents No. 3 and 4 in failing to take up investigation pursuant to the report of the petitioner in respect of FIR No.31/2017, dt.05.05.2017 of Rapur Police Station, Rapur, SPSR Nellore District including arrest of the named accused is illegal, arbitrary, unconstitutional and contrary to the provisions of Cr.P.C and consequently direct the respondents No. 3 and 4 to take up investigation in connection with FIR No.31/2017, dt.05.05.2017 of Rapur Police Station, Rapur, SPSR Nellore District forthwith by apprehending the named accused and pass such pass ...” At the time of hearing, learned counsel for the Petitioner would submit that on the complaint given by the Petitioner, police registered a case in Crime No.31 of 2017 of Rapur Police Station against the unofficial respondents and that there is no progress in the investigation of the said crime. Sri V.Farooq, learned Assistant Government Pleader on written instructions would submit that investigation of the subject crime is completed and referred the matter as „False‟ and would submit that the Court may pass appropriate orders. In that view, this Writ Petition is disposed of. Petitioner is at liberty to recourse the remedy before appropriate forum according to law. No order as to costs.
