The petitioner through instant petition under Articles 226 and 227 of the Constitution of India is seeking direction to respondent to consider his claim for pension as per judgment of Supreme Court in The Employees Provident Fund Organisation and another vs. Sunil Kumar B. and others, 2023 (2) SLR 370. 2. The petitioner submits that he has retired on attaining the age of superannuation on 31.12.2016. He is entitled to pension as per judgment of Supreme Court in Sunil Kumar B. (supra). Mr. Rajesh Hooda, Advocate, who on advance is present in Court, submits that competent authority would consider of petitioner in accordance with applicable law as well as judgment of supreme court in Sunil Kumar B. (supra). He further submits that employer of the petitioner is not submitting record. 4. Mr. P.K. Chugh, Advocate agrees with the aforesaid arrangement. 5. In the wake of statement of both sides, instant petition stands disposed of. Let the needful be done within 3 months from today. 6.
