order or direction declaring the action of the the 2nd respondent in interfering in a civil dispute between the petitioner and the 3rd Respondent herein with his official capacity without having any complaint or legal grounds threatening
them by frequently instructing to come and sit his police station for transferring the house property i.e., H.No.11-107, situated at Kesarapally Villiage and Mandal, Krishna District, to an extent of 128 Sq.yards, in 1st petitioner's in favour of 3rd respondent herein as otherwise, the petitioners will booked in false cases as accused, as illegal, arbitrary and violative of principles of natural justice etc., and consequently to direct the 2nd Respondent herein not to interfere in a civil dispute without having any locus standi including threatening the petitioners directing them for their frequent visits to the 2nd respondent police station, etc., and grant IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased please to direct the 2nd Respondent not to harrass the petitioners to visit his station time to time, pending disposal of the writ petition, in the interests of justice and in the circumstances of the case. ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ of Mandamus or any other appropriate Writ, order or direction declaring the action of the the 2nd respondent in interfering in a civil dispute between the petitioner and the 3rd Respondent herein with his official capacity without having any complaint or legal grounds threatening them by frequently instructing to come and sit his police station for transferring the house property i.e., H.No.11-107, situated at Kesarapally Villiage and Mandal, Krishna District, to an extent of 128 Sq.yards, in 1st petitioner's in favour of 3rd respondent herein as otherwise, the petitioners will booked in false cases as accused, as illegal, arbitrary and violative of principles of natural justice etc., and consequently to direct the 2nd Respondent herein not to interfere in a civil dispute without having any locus standi including threatening the petitioners directing them for their frequent visits to the 2nd respondent police station, etc., and grant.…”
2. None represented for the petitioners.
3. Learned Assistant Government Pleader for Home, on written instructions would submit that the police are not interfering in the civil disputes between petitioners and the unofficial respondent.
4. Recording the above said submission, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the petitioners and the unofficial respondent. There shall be no order as to costs.
