KA AMY/PGA-CR.124/2016/17 VIDE ANNEXURE-A AND ETC.,
THIS WRIT PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCIALIATION ORDER IS PASSED:
CONCILIATION ORDER
3 In this petition, the petitioner has prayed for quashing the order dated 24.06.2022 passed by the 2nd respondent, Labour Officer/Controlling Authority under the gratuity Act, Mysuru in case No. KA AMY/PGA-CR.124/2016/17 vide Annexure-A and also to quash the order passed by the Labour Commissioner and Appellate Authority under the Gratuity Act, Mysuru Division, Mysuru dated 18.04.2023 in Case No.Saka amy/PGA/CR-17/2022-23, vide Annexure-C.
After negotiations, the parties have arrived at settlement. Accordingly, both the parties have filed a Joint Memo duly signed before the Lok Adalath. The said Joint Memo reads as follows:
1. The petitioner 3 Corporation has agreed to pay gratuity amount of Rs.32,821/- with 8% interest from the date of application till the date of deposit in full and final settlement of the case. 2. The respondent has agreed to receive the above stated amount as full and final settlement. 3. The excess gratuity amount deposited by the Corporation should be refunded to Corporation. 4
4. The parties to the proceedings have agreed for the above terms.
Accordingly, this Writ Petition is disposed of in terms of the Joint Memo modifying the order dated 24.06.2022 passed by the 2nd respondent, Labour Officer/Controlling Authority under the gratuity Act, Mysuru in I.D. No. KA AMY/PGA-CR.124/2016/17 vide Annexure-A, and also to quash the order passed by the Labour Commissioner and Appellate Authority under the Gratuity Act, Mysuru Division, Mysuru dated 18.04.2023 in Case No.Saka amy/PGA/CR- 17/2022-23, vide Annexure-C, and directing the petitioner to settle the respondent's entitlement as agreed as expeditiously as possible but within an outer limit of four[4] months from today.
