This petition under Section 528 of the B.N.S.S. has been filed for expediting the proceedings of petition under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 for dissolution of marriage by decree of divorce. 3. Mr. Akshay Latwal, learned Assistant Government Advocate present in the Court would raise strong objection to this misuse of Section 528 of the B.N.S.S. as the same cannot be used in respect of the civil matters. 4. At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh under the appropriate provisions, as per law. 5.
