Neutral Citation No. - 2025:AHC:81995-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 998 of 2025 Petitioner :- Jauni Raj Respondent :- State of U.P. and 3 others Counsel for Petitioner :- Vipul Babu Sharma Counsel for Respondent :- Akanksha Mishra, Jagdish Pathak (S.C.), Sanjay Kumar Dubey Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition purportedly in public interest has been filed by the petitioner seeking institution of enquiry against respondent no. 4 with the allegation that he has obtained compassionate appointment based on a forged adoption deed. 2. Submissions have been made that the compassionate appointment has been obtained by the respondent no. 4 based on unregistered and forged adoption deed and, therefore, the respondents be directed to institute an enquiry in this regard. 3. Learned counsel for the respondents raised preliminary objection that as the appointment of respondent no. 4 has been challenged, the same essentially falls within the category of service matter and as laid down by Hon'ble Supreme Court that PIL in service matter is not maintainable and, therefore, the same deserves to be dismissed. 4. Having considered the subject matter of the petition and the objection raised by the learned counsel for the respondents, we find that in challenging the appointment granted to respondent no. 4 on compassionate basis, apparently no public interest is involved. 5. Consequently, the petition has no substance and the same is, therefore, dismissed.
