ORAL ORDER
Petitioner is seeking to enlarge him on bail in Cr.NO.72/2025 of Peenya Police Station, Bengaluru City, registered for the offence punishable under Section 62, 64, 74, 75(2) of BNS, 2023.
2. Heard both sides and perused the material on record.
3. It is alleged that on 9.2.2025, at about 4.00 p.m., when the victim/complainant was sleeping in the house, the petitioner made an attempt to commit rape on her by gagging her mouth, touched her breast and dragged her etc. When she screamed, the neighbours came to her rescue and informed the matter to the police and the petitioner was apprehended.

4. It is contended by the learned counsel that the petitioner is innocent and the entire allegations against him are false. There are discrepancies and contradictions in the statement of the victim in the complaint and the statement recorded by the learned Magistrate. The investigation is completed and chargesheet is filed and therefore, petitioner may be enlarged on bail imposing conditions.
5. The learned High Court Government Pleader has contended that in view of the statement of victim, there is a prima facie case against the petitioner and if he is granted bail, he may try to intimidate her and hamper the case of prosecution.
6. As per the complaint averments, when the victim was alone in the house, at about 4.00 p.m., on 9.2.2025, petitioner made an attempt to commit rape on her and when she screamed, the neighbours rescued her and caught the petitioner.

7. Petitioner was arrested on 9.2.2025. He is in custody since then. Investigation is completed and chargesheet is filed. Petitioner has no criminal antecedents. He has undertaken to furnish adequate surety to ensure his regular presence before the trial Court. His further detention in custody will not serve any purpose. Hence, the following:
ORDER I. Petition is allowed. II. Petitioner/accused in Crime No.72/2025 of Peenya Police Station, Bengaluru City, shall be enlarged on bail, subject to following conditions:
1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only), with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform

the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall not indulge himself in committing any offence.
5. He shall appear before the trial Court regularly on all dates of hearing. Violation of any of the condition shall result in cancellation of bail.
