Heard learned counsel for the parties. 2. Learned counsel for the petitioner has submitted that the issue involved in this case has been covered by the judgment of this Court passed in Special Appeal No.26 of 2025 State of U.P. and 2 others Vs. Usman Kausar and 12 others with Special Appeal No.27 of 2025 on 07.02.2025 wherein the division Bench of this Court while disposing of the said appeals has held that if any advertisement for appointment of any post which was made prior to 28.03.2005 though the petitioner was appointed subsequently but based on the date of advertisement, he is entitled for Old Pension Scheme on attaining the age of superannuation. 3. In view of the said observations made in the above special appeals, the instant writ petition is also disposed of with the same terms. 4. It is needless to mention that the authorities shall consider claim of the petitioner if his case falls within ambit of the Government Order dated 28.06.2024 and shall pass appropriate orders by way of releasing post retiral benefits within a period of two months from the date of receipt of the copy of this order.
