Neutral Citation No. - 2025:AHC:70787-DB Court No. - 21 Case :- WRIT - C No. - 13833 of 2025 Petitioner :- Badan Singh And Another Respondent :- State Of Uttar Pradesh And 7 Others Counsel for Petitioner :- Jay Prakash Singh,Sita Ram Yadav Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Anish Kumar Gupta,J. 1. The petitioners have prayed for a writ of mandamus restraining respondent no. 2 from releasing compensation of Gata No. 581, area 0.1290 hectare. An application dated 11.4.2025, addressed to ADM, Land Acquisition, Agra, has also been annexed and from which, it transpires that there is some dispute relating to title between the petitioners and the private respondents and in context of the same, the prayer has been made for not releasing the compensation. However, the postal receipt by which the said representation/application was allegedly sent, reveals that the representation was in fact sent to District Magistrate, Agra and not to ADM, Land Acquisition, Agra. 2. In case there is any title dispute, the same has to be raised before the Competent Authority so that decision in accordance with the provisions of Section 3H(3) or (4) of the National Highways Act, 1956 is taken. 3. Accordingly, we dispose of the instant petition with liberty to the petitioners to move appropriate application before the Competent Authority, if so advised. (Anish Kumar Gupta, J.)
