PUBLIC PROSECUTOR The Court made the following: 2 ORDER: This criminal petition has been filed, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to enlarge the petitioner- accused No. 2 on bail in crime No. 27 of 2022 of Special Enforcement Bureau Station, Bheemunipatnam, Visakhapatnam District, registered for the offence punishable under Section 8 (c) read with Section 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985, on the allegation of the petitioner-accused No. 2 had indulged in dealing with 80 K.Gs. of Ganja. 2. Heard learned counsel for the petitioner-accused No. 2 and learned Assistant Public Prosecutor appearing for the respondent-State. 3. The allegation against the petitioner-accused No. 2 is that he had indulged in dealing with 80 K.Gs. of Ganja. It is a commercial quantity. The petitioner was arrested on 12-08-2025. He has been in judicial custody for the past 64 days. The alleged offence took place in the year 2022. The prosecution alleges that the petitioner-accused No. 2 is the supplier of Ganja. Learned counsel for the petitioner submits that based on the confession of accused No. 1, the petitioner-accused No. 2 is implicated in this case. Investigation was completed. Charge sheet has also been filed and the same is numbered as NDPS S.C.No. 464 of 2025. In view of filing of charge sheet, accusation is well founded. 4. Considering the facts and circumstances of the case and the nature and gravity of allegations levelled against the petitioner, this Court is not inclined to enlarge him on bail. 3 5.
