JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the accused No.1 under Section 483 of Bharathiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in Crime No.202/2025 of Tarikere Town Police Station, Chikumagaluru registered for offences punishable under Sections 352, 181(1), 109(1), 351(2) of Bharatiya Nyaya Sanhita, 2023. 2. Heard the learned for petitioner and the learned Additional State Public Prosecutor for respondent/State. 3. The learned counsel for the petitioner would contend that, the allegation against the petitioner is assault by stone and pressing of the neck. The injured has - 3 - HC-KAR NC: 2025:KHC:50136 CRL.P No. 14983 of 2025 sustained only one simple injury on his forehead. The alleged stone has been seized. The petitioner is in custody since 08.10.2025, and as major portion of the investigation is over, he is not required for custodial interrogation. One case registered against the petitioner for offence punishable under Section 302 of IPC has been acquitted, and other two cases are pending, and the other four cases are filed under Section 107 of Cr.PC. With this, he prayed to allow petition. 4. Per contra, the learned Additional State Public Prosecutor for the respondent/State would contend that, the wound certificate indicates that, the injured has sustained lacerated wound on his right forehead. The assault is made by the stone, and it has been recovered. The investigation is in progress. The petitioner is involved in eight criminal cases. If the petitioner is granted bail, there are chances again committing similar offences. With this, she prayed to reject the petition. - 4 - HC-KAR NC: 2025:KHC:50136 CRL.P No. 14983 of 2025 5. Having heard the learned counsel, the Court has perused the complaint, FIR and other materials placed on record. 6. On perusal of averments of the complaint, the quarrel has taken place between the petitioner and the injured. In the said quarrel, the petitioner is stated to have assaulted the injured with stone fallen there on his forehead near right eye, and caused bleeding injury, and tried to press his neck. At that time, persons came there and pacified the quarrel. The wound certificate of the injured indicates that, he has sustained a lacerated wound measuring 0.5 centimetres over the right forehead, and it is stated to be simple in nature. The cases said to be registered against the petitioner prior to this case are in the year 2019 and previous to that year. The petitioner has undertaken to co-operate with the Investigating Officer in the investigation. - 5 - HC-KAR NC: 2025:KHC:50136 CRL.P No. 14983 of 2025 7. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No.202/2025 of Tarikere Town Police Station, Chikkamagaluru registered for offences punishable under Sections 352, 181(1), 109(1), 351(2) of Bharatiya Nyaya Sanhita, 2023 subject to following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the like sum to the satisfaction of the jurisdictional Court. b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. - 6 - HC-KAR NC: 2025:KHC:50136 CRL.P No. 14983 of 2025 c) The petitioner shall co-operate with the Investigating Officer in further investigation, if any. d) The petitioner shall not commit any offence. If he is found involved in commission of any offence, the prosecution is at liberty to seek cancellation of bail granted to him. e) The petitioner shall mark his attendance on every fourth Sunday of each month before the jurisdictional police station till the case registered against him is disposed of.
