It is submitted to the Court that the deceased had a suicidal death by hanging. A copy of the P.M. Report is produced and the cause of the death is shown therein as Asphyxia and venous congestion as a result of ante-mortem hanging. It is claimed that the husband of the deceased is outside India and presently in Germany. Recorded the objection of the State. p. 2
4. The Court finds that earlier the petitioners were issued notices under Section 35(3) BNSS in connection with Berhampur Mahila P.S. Case No.111 dated 26th August, 2025 registered under Section 498-A I.P.C. The death of the victim has taken place by hanging and it was while she was staying with her parents. Considering the above facts and
submissions of learned counsel for the respective parties and the nature of allegations directed against the petitioners for having ill-treated the victim, this Court though not inclined to grant pre-arrest bail to them, but is of the view that they should be directed to surrender before the learned court below for being released with suitable conditions imposed.
