ORDER Date : 22.09.2025 Heard Mr. J. Tsering, learned counsel for the petitioner and also heard Mr. O. Modi, learned counsel for respondent No. 2 and M. N. Danggen, learned counsel for respondent No. 5 and Mr. G. Tado, learned Additional Public Prosecutor for the State respondent No. 1. Ms. N. Danggen, learned counsel for respondent No. 5, while placing the
order dated 04.07.2025, passed by the Session Judge, Yupia, submits that in the
Page No.# 3/3 instant case, the respondent Nos. 2, 3 and 4 were never been charge-sheeted, and respondent No. 5, namely, Shri Kapa Rai, has been discharged by the Sessions Court, Yupia. In view of the above, she submits that the matter has become infructuous and therefore, prays for closing the petition. The order dated 04.07.2025, is taken on record and marked as document ‘X’ for identification. The learned counsel for the petition has no objection. I have perused the order and the order does not reflect the names of respondent Nos. 2, 3 and 4, as they were not charge-sheeted and the respondent No. 5, namely, Shri Kapa Rai has been discharged as no offence was made against him.
