ORDER This writ petition has been filed seeking a writ of mandamus forbearing the respondents 7 to 10 from harvesting the cashews.
2. The grievance of the petitioner is that he was the successful bidder in the auction conducted by the 3rd respondent on 01.12.2022 for the yield of cashews for the year 2022-23. The necessary payments were also made, and an allotment order was granted in his favour by the 3rd respondent. However, the respondents 7 to 10 herein are preventing the petitioner from harvesting the cashews. In this regard, he gave representations to the police officials on 07.02.2023 and 05.05.2023 seeking protection, but no auction has been taken so far. 3/6 https://www.mhc.tn.gov.in/judis
WP No. 15278 of 2023
3. However, as the period covered by the present auction has already expired, the immediate relief sought in this writ petition has become infructuous. Nevertheless, if the petitioner becomes the successful bidder in any future auction and any disturbance is caused, on receipt of a complaint from the petitioner, the respondent police shall extend necessary protection.
4. With the above observations and directions this writ petition is
disposed of. No costs. 20-08-2025 mrp Index:Yes/No Speaking/Non-speaking order Internet:Yes Neutral Citation:Yes/No 4/6 https://www.mhc.tn.gov.in/judis
