1. Mr. Amar Murti Shukla, learned counsel holding the brief of Mr. Mukesh Rawat, learned counsel for the applicant.
2. Mr. Siddhartha Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State.
3. The present applicant ‘Gaurav Singh Bisht’ S/o Sri Balwant Singh is praying for regular bail in relation to First Information Report dated 14.01.2025 bearing FIR No. 04 of 2025 P.S. Kotwali Almora, District Almora, wherein, the present applicant along with one Deepak Singh Bisht were implicated for the offence punishable under Section 2/3 of U.P. (Uttarakhand) Gangster and Anti Social Activities Prevention Act, P.S. Kotwali Almora, District Almora.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated only on the basis of three cases out of which two cases relates to NDPS and other one relates to the offence punishable under Sections 379 r/w 411 of IPC and for the offence punishable under the NDPS Act the applicant is already enlarged on bail and in respect of the offence under Section 379 r/w 411 of IPC the applicant has been implicated only on the basis of confessional statement.
5. Apart from this, he further submits that the other co accused have already been enlarged on bail by this court against whom one case also pertains to Section 379 r/w 411 of IPC wherein he was convicted.
6. Learned State counsel have not disputed this fact that the other co accused Deepak Singh Bisht have already been enlarged on bail and the case of the applicant is on the same footing.
7. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the other co accused have
2025:UHC:3688 already been enlarged on bail, this court is of the view that the applicant deserves for bail.
8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
9. Let the applicant ‘Gaurav Singh Bisht’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
10. It is made clear that after being released on bail the applicant will report his presence to the concerned police station within each 15 days and the concerned SHO shall record his presence.
