This application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [BNSS] seeking anticipatory bail in connection with FIR No.182/2025 for the offence punishable under Section 118(1)/3(5) of BNSS registered at Police Station Sarita Vihar, GNCTD of Delhi. 2. This matter was first time called out on 18.07.2025 and the Court while issuing notice directed that no precipitate action shall be taken against the petitioner till the following date of hearing. 3. It is, however, stated that in the interregnum the petitioner appeared before the Investigating Officer [IO] as and when he was called for. The petitioner submits that he has fully co-operated with the IO. 4. Ms. Shubhi Gupta, learned APP, appearing for the State, on instructions, states that the investigation has been completed and the prosecution is in the process of filing the final charge-sheet. It be also noted that this Court directed for service of notice on the complainant. It is submitted that the notice was served on the complainant and despite service, none appears. The prosecution story would indicate that on 17.02.2025 at about 12.30 A.M. the complainant - Rahil Khan was present with his friends at Saabu’s jhuggi. During this time, the petitioner - Mohammad Monis @ Bhola allegedly attacked him with a sharp object, while Ballu @ Kadir facilitated Bhola’s escape. As a result, Rahil Khan sustained a stab injury on the left-side of his chest along with abrasions and multiple bruises. He was immediately sent for medical examination and based on his statement the FIR in question has been registered. 6. Learned counsel appearing for the petitioner submits that he has been falsely implicated and the medical report reflects a superficial stab wound of 1x1 cm with undetermined depth and minor abrasions. There is no life threatening injury, nor any proof of intent to cause death or grievous hurt. 7. I have heard the learned counsel appearing for the parties and have perused the record. It be noted that the investigation of the FIR in question has already been completed. There is no criminal antecedent of the petitioner. The Court has also perused the Medico-Legal Certificate [MLC] and finds that looking at the nature of the injury the petitioner is entitled for extension of the interim protection which was already granted vide order dated 18.07.2025. The petitioner undertakes to co-operate with the concerned IO and once the charge-sheet is filed, to render assistance before the trial Court. 8.
