1. By way of present petition, the Central Railway raised the challenge to the order passed by the Central Administrative Tribunal, Mumbai Camp at Nagpur, in Original Application No.710 of 2021, directing the petitioners to reconsider the claim of the ex-gratia amount taking note of R.B.E. No. 285 of 1999 and R.B.E. No.139/2016 and observation made in the order, within a period of 90 days from the date of the receipt of the certified copy of the order.

We are surprised to know that though this
order is not adverse, the same came to be challenge by way of present petition. If the directions of the Tribunal are looked into, it only asked to decide the claim of ex-gratia amount within a period of 90 days from the date of receipt of the certified copy of the order of the Tribunal.

The learned counsel for the petitioners could not justify the reason to file this petition. Thus, the petitioners cannot be considered as an aggrieved party.

In the circumstances, we dismiss the present writ petition with costs of Rs.25,000/- to be paid to the respondent No.1 within four weeks from today.

Place this matter on 17.09.2025 for compliance to enable the petitioners to file receipt of payment of costs on record.
