Learned counsel for the petitioner submits that the identical issue has been raised before this Court and has already been decided by the Hon’ble Division Bench as well as by the Co-ordinate Bench of this Court. Accordingly, he prays that this petition may be 3 disposed of in light of the orders passed by the Division Bench in Writ Appeal No. 88 of 2019 and the Co-ordinate Bench in Writ Petition (S) No. 5604 of 2023. 3. Learned State counsel does not oppose the submission made by learned counsel for the petitioner. 4. In view of the decisions rendered by the Hon’ble Division Bench in Writ Appeal No. 88 of 2018 and the Co-ordinate Bench in Writ Petition (S) No. 5604 of 2023, this petition is allowed in terms of the said orders. It is hereby ordered that the period of service rendered by the petitioner as a daily wages employee prior to regularization shall be counted for the purpose of calculating retiral dues, including pensionary benefits. It is, however, made clear that such implementation shall be subject to due verification of the petitioner’s service records. 5. Accordingly, this petition is allowed.
