JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 4 16-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offence under Sections 126(2)/115/109/351/ 352/3(5) of the B.N.S. 3. As per F.I.R., on account of a dispute relating to non-payment of remuneration, when the informant raised his grievance, allegedly, the petitioner along with other co-accused persons brutally assaulted him. It is specifically alleged that on the exhortation made by co-accused, Sunita Kumari and Neha Kumari assaulted the informant by means of lathi due to which he sustained injuries. 4. Learned counsel for the petitioner submits that there is no date, time and place of occurrence in the F.I.R. There Patna High Court CR. MISC. No.47828 of 2025(4) dt.16-09-2025 2/2 is general and omnibus allegation of assault against all the accused persons. Case and counter case. Similarly situated co- accused, namely, Sunita Devi and Neha Kumari have already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 20.05.2025 passed in Cr. Misc. No. 31019 of 2025. Petitioner claims clean antecedent. 5. Learned A.P.P. for the State has opposed the bail petition. 6. Considering general and omnibus allegations and also the clean antecedent of the petitioner, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail- bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Siwan , in connection with Mairwa P.S. Case No. 07/2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482(2) of BNSS, 2023. Saif/- (Prabhat Kumar Singh, J) U T
